The rules for using Morph. Short, and written so you can actually read them.

The app is free

There is currently no subscription, in-app purchase or paywall in Morph.

Using your own photos is free and unlimited and is not placed behind a style system or credit.

How old you need to be

Morph is intended for people aged 13 and over. If you are under 13, do not create an account or use Morph.

If you are old enough to use Morph but are not old enough to enter a contract where you live, you need a parent or guardian to agree to these Terms on your behalf. Buying a case is their decision too.

Your designs are yours

You keep ownership of everything you make in Morph.

We do not claim ownership of your designs or require a licence to use them for our own purposes. Your designs stay on your phone and are not uploaded to Morph's servers. Sending a design to your case does not send the design to us.

Sharing

Morph currently has no sharing or community feature. Nothing you make is shown to other people through the app.

If we add sharing or community features in the future, we will update these Terms before introducing them and explain how those features work.

The case, and what we can honestly promise

Sending a design to your case uses NFC and requires the case to be connected to a compatible phone. Transfers can occasionally fail.

If a transfer does not complete successfully, the case may continue to show its previous design, or the display may not update as intended.

The app will tell you when a transfer fails and, where possible, explain what happened and what to do next.

The E-Ink panel is designed to have a different appearance from a phone screen. Colours may appear softer or different from how they look in the app. The app provides a preview so you can see how a design is expected to appear before sending it to your case.

Things outside our control

The app may require an internet connection for certain account and online services. Drawing, editing, using your own photos and sending a design to your case can work offline where the relevant functionality has already been loaded.

Some features may depend on your phone, operating system, NFC functionality, internet connection or other services being available.

We provide the app as it is. We cannot promise it will never have a fault or never be unavailable.

Nothing in these terms takes away rights you have under the Australian Consumer Law or equivalent laws where you live.

What we are responsible for

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded, restricted or modified, including rights you may have under the Australian Consumer Law.

Where the law permits us to limit our liability, our liability is limited to the extent permitted by law.

Because the Morph app is provided free of charge, we are not responsible for indirect or consequential loss arising from your use of the app, such as lost time, lost income or loss of a design that existed only on your device, except where liability cannot legally be excluded or limited.

We are not responsible for problems caused by your phone, operating system, NFC hardware, another app, network connection or other circumstances outside our reasonable control.

Your Morph case is a separate product. Its warranty and consumer rights are dealt with separately, and nothing in these Terms limits your rights under the Australian Consumer Law in relation to a case you purchase.

Ending it

You can stop using Morph and delete your account at any time, from Settings.

We may suspend or terminate access to Morph where reasonably necessary, including if you materially breach these Terms, misuse the service, or use Morph in a way that could harm the service, other users or our systems.

If these terms change

If we change these terms we will update this page and change the date at the top. If a change is significant we will tell you in the app rather than quietly editing the page.

If you continue using Morph after the updated Terms take effect, you will be agreeing to the updated Terms to the extent permitted by law. If you do not agree with them, you can stop using Morph and delete your account from Settings, and nothing about the case you own depends on it.

Which law applies

These Terms are governed by the law of New South Wales, Australia, and the courts there can hear a dispute about them.

If you live somewhere else, this does not take away the consumer protections of your own country. You can still bring a claim where you live if the law there says you can.

If part of this does not hold

If a court decides that one part of these Terms cannot be enforced, the rest of the Terms will continue to apply.

If we do not immediately enforce a right under these Terms, that does not mean we have permanently given up that right.
